Charleston Failed Field Sobriety Defense Lawyer

If a police officer suspects that you were driving drunk or were driving under the influence of drugs, he or she will ask you to perform a series of field sobriety or coordination tests. The results of these tests are meant to be used as preliminary evidence to determine whether you may be over the legal limit. However, these tests are subjective and are often unreliable. Retaining experienced legal counsel who can challenge these results is crucial to building a strong defense against DUI charges.

I am Ravi Sanyal, a Charleston failed field sobriety defense attorney and founder of the Sanyal Law Firm, LLC. With more than a decade of experience working as a DUI prosecutor, I understand how to challenge the state’s evidence in an effort to help you achieve the best possible results. Challenging the Results of Field Sobriety Tests

Sobriety test results are often used in tandem with the results of Breathalyzer tests to help the state build its drunk driving case. However, these tests, even when performed under optimal conditions, are never 100 percent reliable. I will work hard to discount the results of these tests to help show that your DUI/DUAC arrest was not supported by the evidence.

You may refuse to submit to field sobriety tests without facing increased penalties. However, refusing to submit to a Breathalyzer test (or a blood or urine test) following your arrest will result in an automatic driver’s license suspension. Even if a breath test shows a blood alcohol concentration (BAC) that is over the legal limit of .08, there are still a number of defenses that may be raised. It may be possible to have your charges reduced or even dismissed altogether. I am committed to protecting your rights and your freedom.
